Terms of Service

These terms and conditions (the "Terms") apply to the use of the Kasello application and related services (the "Application") between you as a user ("You") and Kasello AB ("Kasello", "we", "our", "us"), Swedish reg. no. 559562-5327, a company incorporated under the laws of Sweden.

By accessing or using the Application, You agree to be bound by these Terms. If You do not accept the Terms, You may not use the Application. Please read the Terms carefully before using Kasello.

Kasello reserves the right to amend these Terms at any time. Changes will be communicated via the Application and/or published within the service. Unless otherwise required by law, amended Terms will take effect thirty (30) days after publication.

1. Definitions

1.1 Application

The website, mobile applications, and digital services provided by Kasello.

1.2 Information

All content, data, text, images, trademarks, videos, statistics, and other material uploaded, generated, or made available by You or other users through the Application.

2. Registration and user information

2.1

By registering an account, joining a team or organization, or otherwise using the Application, You enter into a legally binding agreement with Kasello. You confirm that You have the legal capacity to enter into this agreement or have obtained required consent (e.g. parental or organizational consent).

If You register or act on behalf of a team, organization, school, or club, You confirm that You are authorized to do so.

2.2

You warrant that all information You provide is accurate, current, and complete.

2.3

Your login credentials are personal and confidential. You are responsible for keeping them secure and for all activity conducted through Your account.

2.4

Kasello may treat all activity performed through Your account as performed by You.

3. Payments

3.1

Kasello uses Stripe as its third-party payment service provider for all payments facilitated through the Application.

3.2

Kasello does not process or store payment card or bank details. All payment data is handled by Stripe in accordance with Stripe's own terms and privacy policy.

3.3

By making or receiving payments through Kasello, You agree to be bound by Stripe's applicable terms.

4. Intellectual property rights

4.1

All software, design, functionality, trademarks, and content provided by Kasello remain the exclusive property of Kasello or its licensors.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Application without prior written consent from Kasello.

4.2

When uploading Information, You confirm that You hold all necessary rights and that such Information does not:

Infringe third-party rights

Contain unlawful, offensive, abusive, or misleading material

Include malware, spam, or harmful code

Contain sensitive personal data unless explicitly permitted

4.3

By uploading Information, You grant Kasello a royalty-free, non-exclusive right to store, process, and use such Information solely for operating and improving the Application.

4.4

Kasello may remove any Information that violates these Terms without compensation or prior notice.

5. Use of the Application

5.1

You agree to use the Application respectfully and lawfully.

5.2

You may not misuse the Application, interfere with its operation, or attempt unauthorized access.

5.3

You are solely responsible for all Information You upload or actions You take within the Application.

6. Accounts, roles, and groups

6.1

Users may have different roles, including administrators and members, typically connected to a team or organization ("Group").

6.2

Administrators may manage Groups, campaigns, and members within the scope of their permissions.

6.3

Kasello may reassign or revoke administrative rights if misuse or unauthorized control is identified.

6.4

Kasello may change role permissions or functionality to improve the service.

7. Privacy

7.1

Your privacy is important to us. Our processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

7.2

You are strongly advised not to publish sensitive personal information (such as personal identity numbers, passwords, or bank details) in the Application unless explicitly requested.

8. Limitation of liability

To the maximum extent permitted by law, Kasello shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, loss of profits, or business interruption.

Kasello's total liability shall in all cases be limited to the amount paid by You to Kasello during the twelve (12) months preceding the claim.

9. No warranties

The Application is provided "as is" and "as available" without warranties of any kind. Kasello does not guarantee uninterrupted availability, accuracy of content, or that the Application will meet Your expectations.

10. Indemnification

You agree to indemnify and hold harmless Kasello from any claims, damages, or costs arising from:

Your breach of these Terms

Your misuse of the Application

Information You upload

11. Suspension and termination

11.1

Kasello may restrict or terminate Your access if You violate these Terms or misuse the Application.

11.2

You may terminate Your account at any time by deleting it through the Application.

11.3

Upon termination, Information may be anonymized for statistical or historical purposes.

12. Assignment

You may not assign Your rights or obligations under these Terms without Kasello's prior written consent.

13. Severability

If any provision is found unenforceable, the remaining provisions shall remain in effect.

14. Waiver

Failure by Kasello to enforce any right shall not constitute a waiver of such right.

15. Governing law and jurisdiction

These Terms shall be governed by Swedish law.

Any dispute shall be settled by Swedish courts, with Stockholm District Court as the court of first instance.
